Islamabad High Court orders release of minor offenders from Adiala Jail

Islamabad High Court orders the release of prisoners of minor offenses in Adiala jail on bail due to coronavirus.

Chief Justice of the Islamabad High Court, Athar Minallah, heard the release of 1362 prisoners on bail in connection with the spread of the Coronavirus.

Deputy Commissioner Islamabad Hamza Shafqat appeared before the court in person.

During the hearing, Chief Justice Athar Minallah asked him what was the policy of the jail administration on which the Deputy Commissioner stated that 'no Coronavirus has been diagnosed in the prison till now'.

"Meetings in Adiala Jail have been stopped," he said.

Justice Athar Minallah said that if a virus is spread among the prison inmates, it will be very difficult, yet only China is able to prevent the spread of the virus and even in China, there are 2 prisons to spread the virus. Afterward, matters got worse. '

He remarked that "even people accused of harassment get to jail, so those with minor offenses should not get to jail, no prisoner should be allowed to enter or out without screening."

He said that under section 401, the administration and the government related to sick prisoners are empowered, their punishment should be suspended while some prisoners may be temporarily released on the payroll.

Later, the Islamabad High Court issued a verdict on the prisoners of Adiala jail due to the Coronavirus and released them on bail bonds for minor offenses.

The court ruled that "the deputy commissioner should appoint an officer who will look into the cases of the bailiffs, who cannot submit to the prisoners and give them to the government himself."

The Chief Justice said: "These are emergency situations. All actions have to be taken. Our nation will not be scared but it will have to take action."

The court said that "the prisoners who are in the police station can take them to the station house officer (SHO). We will also issue a written order regarding the prisoners in the police station."

He said, "Only those arrested under these circumstances would be at great risk, if the Corona were not controlled, the loss would not be resolved for 50 years".

On this occasion, PML-N lawyer Jahangir Jadoon asked the court whether the court orders should be applied to the prisoners of NAB, on which the court said that the authority of the NAB prisoners belongs to the provincial governments, we are in jail. Orders on prisoners of minor crimes to reduce the number of prisoners
